Terms of Service

1. These Terms

1.1. These are the terms and conditions on which we supply products to you.

1.2. Please read these terms carefully before you submit your first order to us. They tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. If you think there is a mistake in these terms, please contact us to discuss.

2. Information about us and how to contact us

2.1. We are BREWSER, a company registered in England and Wales. Company registration number: 13221718. VAT number: 381579168. Personal licence number: LBWands/05912. Our partner breweries operate under individual premises licences.

2.2. You can contact us through our help widget or by emailing hello@brewser.beer.

2.3. If we need to contact you, we will do so at the email address you provided in your first order.

2.4. "Writing" and "written" in these terms includes emails.

3. Our contract with you

3.1. By signing up to Brewser, you are agreeing to a recurring monthly subscription (unless paused) until cancelled by either you or us.

3.2. By signing up, you confirm that you and anyone you may be purchasing for are 18 years of age or older. This service is designed and intended for adults only.

3.3. Our acceptance of your order takes place when you make your first payment, at which point a contract comes into existence between us.

3.4. We will assign an account number to your order when you sign up. Please quote this number when contacting us about your subscription or deliveries.

3.5. We only sell and deliver within the UK. We will cancel any accounts created with the purpose of shipping outside the UK or to restricted addresses (see 3.6).

3.6. We cannot currently deliver to the Islands of Scotland, Channel Islands, some Scottish Highlands postcodes, or the Republic of Ireland.

4. Our products

4.1. Images on our website show products from previous months and are illustrative only. Goods are selected and curated by our partner breweries, so variation in selection and quantity should be expected month-on-month.

4.2. Product packaging may vary from images shown on our website.

4.3. Goods received are subject to change month-on-month as breweries update and expand their range.

4.4. Although we take reasonable steps to ensure product quality, we rely on our partner breweries' quality assurance and cannot guarantee the quality or quantity of goods received each month. This does not affect your statutory rights.

5. Providing the products

5.1. Delivery is included in the subscription price for standard UK mainland locations. Additional charges apply for the Scottish Highlands, Northern Ireland, and Isle of Man. We aim for next working day delivery once dispatched, though delivery times to Northern Ireland and the Scottish Highlands may vary.

5.2. An order is complete when our courier delivers to the address specified in your Brewser account.

5.3. We are not responsible for late or failed deliveries caused by incorrect address information provided by you. If you update your address after the lock date, we cannot guarantee redirection or offer a refund. Contact hello@brewser.beer as soon as possible in this case.

5.4. We will provide an estimated first delivery date during sign-up. Future deliveries will be monthly around the same date, with variation for public holidays and different breweries.

5.5. We are not responsible for delays outside our control, but we will contact you promptly and take steps to minimise any impact.

5.6. If you are not available for delivery, our courier will attempt delivery twice more or allow you to nominate a safe place or neighbour. If three delivery attempts fail and the parcel is returned, a charge of £17.00 will apply to cover courier costs.

5.7. If you do not rearrange delivery, the courier may charge storage costs. If we cannot reach you despite reasonable efforts, we may end the contract (see clause 10.2).

5.8. We do not currently offer the ability to change your ongoing delivery date.

5.9. Products become your responsibility from the time our courier delivers them to your specified address.

5.10. We may need to suspend product supply to deal with technical problems, update the product to reflect legal changes, or make changes requested by you.

5.11. We may suspend supply if you do not pay when due, and we may charge interest on overdue amounts (see clause 13.4).

6. Your rights to make changes

6.1. Each month has a lock date, visible in your profile, after which your order is confirmed with our partner brewery. You cannot change or cancel that month's order after this date. If you cancel after the lock date, we may withhold a fee of £10 from any refund, at our discretion. Your first order is locked immediately and is not refundable.

6.2. Before the lock date, you can update your brewery selection for the current and future months through your Brewser profile.

6.3. If you do not select a brewery, or your chosen brewery becomes unavailable, we will select one for you from our available partners on the lock date. This is called 'Brewser Selects'.

7. Our rights to make changes

7.1. We may change your selected product if: your chosen brewery cannot fulfil the order; we consider the product to be of poor value or quality; technical changes are required; legal or regulatory requirements change. In these cases, we will assign a brewery via 'Brewser Selects'. If you use a discount code not valid for existing subscribers, or hold multiple subscription accounts, we may recharge the full amount or remove duplicate accounts.

8. Your rights to end the subscription

8.1. You can cancel your subscription through your Brewser profile once your first box has been delivered.

8.2. You cannot change your subscription or products: before your first order has been delivered; after making your first payment as a new subscriber; after the lock date for a given month; or after payment has been taken for a current or future month. If you cancel past the lock date, your subscription will end the following calendar month and you will receive and be charged for the current month's box.

9. How long do I have to make changes?

9.1. You can change your selection for current and future months at any time before the relevant lock date, by visiting your Brewser profile and updating your chosen product, or by pausing or cancelling your subscription.

10. How to end the subscription contract

10.1. You can cancel through your Brewser profile once your first box has been delivered. See clause 8.2 for restrictions.

10.2. If you end the contract after products have been dispatched or delivered, you will not be eligible for a refund unless the products arrive damaged or faulty and you can provide digital photographs to support this.

10.3. We will cover return costs only if products arrived damaged (with photographic evidence). In all other circumstances, you are responsible for return postage.

10.4. Before returning any product, you must contact customer service and provide photographs of the box and all contents for assessment.

10.5. Replacements will be offered for faulty or damaged products. Where a refund is required, a credit note will be added to your Brewser account.

11. Our rights to end the subscription

11.1. We may end the contract by writing to you if you: fail to make payment when due; fail to provide necessary information within a reasonable time; attempt to ship outside permitted UK areas; fail to allow delivery within a reasonable time; engage in abusive, derogatory, extremist, racist, or otherwise harmful conduct linked to Brewser on social media or public forums; commit fraud; leave your account inactive for more than 3 months (6 months if paused); or hold multiple accounts.

11.2. If we end the contract, we will refund any advance payments for undelivered products, minus an administration fee of £20.00.

11.3. If we decide to stop providing a product, we will give at least one month's notice where possible and will set your selection to 'Brewser Selects' in the interim.

12. If there is a problem with the product

12.1. Contact us through the customer service widget on the Brewser platform for any questions or complaints.

12.2. For information about your legal rights, visit www.adviceguide.org.uk or call 03454 04 05 06. See also the Consumer Contracts Regulations 2013, noting applicable exemptions.

12.3. To exercise your legal right to reject products, contact us to arrange a return collection.

13. Price and payment

13.1. The subscription price (including VAT and delivery) is shown on the order page at sign-up and recurs monthly based on the number of boxes selected.

13.2. If the VAT rate changes, we will adjust your charge accordingly unless you have already paid in full.

13.3. We accept payment via debit and credit card through our online payment provider. Your first charge is taken at sign-up, with recurring monthly charges from that date.

13.4. If payment is not made by the due date, we may charge interest at 5% per year above the Bank of England base lending rate, accruing daily from the due date.

13.5. If you believe a charge is incorrect, contact us promptly. No interest will accrue during an unresolved dispute.

13.6. We reserve the right to increase subscription costs by up to 3% above the UK CPI each year, based on the preceding month's figure.

14. Offers, refer a friend, discount codes and credits

14.1. Discount codes are non-transferable and cannot be redeemed for cash. Unless stated otherwise, codes are for new orders only, cannot be used retrospectively, and can only be redeemed once per subscriber, device, and household.

14.2. Only one discount code may be used per transaction. Only one subscription is permitted per household and therefore only one new user discount per household. We reserve the right to recharge or remove duplicate accounts.

14.3. Discount codes are subject to any additional terms specified at the point of issue. We reserve the right to modify or withdraw any codes at any time.

14.4. Account credit (e.g. from sign-up or referrals) cannot be exchanged for cash, is non-transferable, and expires three months from the date of issue. Unused credit is forfeited if your account is closed. Credit applies to monthly subscription costs only.

14.5. Refer-a-friend credits apply only to genuine arm's length referrals to new Brewser subscribers at a different delivery address. Referrals via discount networks or broad social sharing are invalid. Referrer credit is issued once the referee's first payment is processed and is valid for six months. All accrued credit is forfeited if the referrer cancels their subscription.

14.6. You must not share private discount codes or referral links created for your account. Shared codes will be made invalid.

14.7. We reserve the right to reject or reclaim any discount or credit used in breach of these terms.

15. Our responsibility for loss or damage

15.1. You must give us a reasonable opportunity to resolve any issue before incurring costs to remedy it yourself.

15.2. We are not responsible for loss or damage where: it results from products or packaging provided by our breweries; it is outside our direct control; there is no breach of a legal duty of care; it was not a foreseeable consequence; it is caused by your non-compliance with this contract; or it relates to business use.

15.3. Our liability is limited to the price paid for the goods. We are not liable for economic losses, loss of goodwill, special or indirect losses, or data loss.

15.4. We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, breach of your statutory rights, or defective products under the Consumer Protection Act 1987.

15.5. We are not liable for delays or failures caused by circumstances beyond our reasonable control, including third party telecommunications failures.

15.6. We only supply products for domestic and private use. We have no liability for commercial losses if products are used for business purposes.

16. How we use your personal information

We will only use your personal information as set out in our Privacy Policy.

17. SMS

Terms By enrolling in or using our SMS service, you agree to these SMS Terms. We may change or discontinue the service or its features at any time without notice. Continued use after any change to these SMS Terms means you accept them. By opting in, you agree to receive recurring SMS/text messages from or on behalf of Brewser Ltd at the number you provided. Messages may be sent using an automatic dialing system or other automated technology and are powered by Recharge, Inc. Messages may include transactional (e.g., order updates, account alerts) and promotional content (e.g., special offers, product launches, cart reminders). Your consent is not required to make a purchase. Participation is voluntary. Message frequency may vary. Standard message and data rates may apply; check with your carrier for details. To opt out, reply "STOP" to any message. For help, contact us at hello@brewser.beer. Brewser Ltd is not responsible for delayed or undelivered messages. Carriers are not liable for message delays or failures. If your mobile number changes, you must re-enroll to continue receiving messages. If your number is on a Do Not Call registry, your consent still allows us to message you, as permitted by law. 18. Other important terms

18.1. We may transfer our rights and obligations under these terms to another organisation with one month's notice. You may end the contract within that month if you are unhappy with the transfer.

18.2. This contract is between you and us only. No third party has rights to enforce its terms.

18.3. If any part of this contract is found to be illegal or unenforceable, the remaining terms continue in full force.

18.4. Any delay in enforcing this contract does not waive our right to enforce it later.

18.5. These terms are governed by English law. Legal proceedings may be brought in the English courts. If you live in Scotland, you may also use the Scottish courts. If you live in Northern Ireland, you may also use the Northern Irish courts.
